Welcome to ThriveHigh AI by SaptRishi ("ThriveHigh," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the ThriveHigh AI service ("Service"), which operates primarily through the WhatsApp platform and our web application at thrivehigh.ai.

IMPORTANT: By accessing or using ThriveHigh AI, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using ThriveHigh AI through WhatsApp or any other platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have permission from a parent or legal guardian to use ThriveHigh AI. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. User Responsibilities and Content

3.1 Your Content

You may upload, submit, or share various types of content with ThriveHigh AI, including but not limited to text messages, questions, study materials, handwritten notes, PDFs, videos, images, and other educational content (collectively, "User Content").

CRITICAL - COPYRIGHT AND OWNERSHIP: You represent and warrant that:

You own all User Content you upload or have obtained all necessary rights, licenses, consents, and permissions to use and authorize us to use such User Content
Your User Content does not and will not infringe, violate, or misappropriate any third-party intellectual property rights, including copyrights, trademarks, patents, trade secrets, or other proprietary rights
Your User Content does not violate any applicable laws, regulations, or third-party rights
You have the legal right to share any copyrighted materials (such as textbooks, articles, or proprietary study materials) that you upload to our Service

3.2 Prohibited Content

You agree NOT to upload, post, or transmit any User Content that:

Infringes any copyright, trademark, patent, trade secret, or other intellectual property rights of any third party
Contains pirated, illegally obtained, or unauthorized copyrighted materials
Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Promotes illegal activities or violates any applicable laws or regulations
Contains viruses, malware, or any other harmful code
Impersonates any person or entity or misrepresents your affiliation with any person or entity
Violates the privacy rights of any third party
Is used to promote or engage in academic dishonesty, cheating, or plagiarism

3.3 Content Moderation

We reserve the right (but have no obligation) to review, monitor, or remove User Content at our sole discretion. We implement multi-layer safety filters to block harmful or inappropriate content, but we cannot guarantee that all objectionable content will be identified or removed.

4. Intellectual Property Rights

4.1 Your Rights

You retain all ownership rights to your User Content. By submitting User Content to ThriveHigh AI, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, modify, and display your User Content solely for the purposes of:

Providing and operating the Service
Improving our AI models and Service quality
Ensuring safety and compliance with our policies
Responding to your queries and generating AI-powered answers

4.2 Our Rights

ThriveHigh AI, including our website, logo, AI technology, algorithms, software, features, and all related intellectual property, is owned by SaptRishi and is protected by copyright, trademark, patent, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We specifically disclaim any warranty that:

The Service will be uninterrupted, timely, secure, or error-free
The AI-generated answers, insights, or study recommendations will be accurate, complete, reliable, or appropriate for your needs
Any defects or errors in the Service will be corrected
The Service will meet your specific educational or learning requirements

Educational Use Only: ThriveHigh AI is designed as a study aid and educational tool. It should not be used as a substitute for professional tutoring, formal education, or academic advice. You are solely responsible for verifying the accuracy of any information provided by our AI.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THRIVEHIGH AI, SAPTRISHI, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, use, goodwill, or other intangible losses
Any damages resulting from your use or inability to use the Service
Any damages resulting from unauthorized access to or alteration of your transmissions or data
Any damages resulting from reliance on AI-generated content or study recommendations
Any damages resulting from copyright infringement or other legal claims brought by third parties related to your User Content
Any academic consequences (such as failing grades, disciplinary actions, or academic integrity violations) resulting from your use of the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ₹1,000 (ONE THOUSAND RUPEES), WHICHEVER IS GREATER.

7. Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THRIVEHIGH AI, SAPTRISHI, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND PARTNERS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS, DEBTS, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM:

Your use of or access to the Service
Your User Content, including any copyright infringement or intellectual property violations
Your violation of these Terms
Your violation of any third-party rights, including copyright, trademark, privacy, or other proprietary rights
Any claim that your User Content caused damage to a third party
Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these Terms and your use of the Service.

8. Copyright Infringement Policy

8.1 DMCA Compliance

We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyrighted work has been copied or uploaded to our Service in a way that constitutes copyright infringement, please provide our designated Copyright Agent with the following information:

A physical or electronic signature of the copyright owner or person authorized to act on their behalf
Identification of the copyrighted work claimed to have been infringed
Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
Your contact information, including address, telephone number, and email address
A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

8.2 Repeat Infringer Policy

We will terminate the accounts of users who are determined to be repeat copyright infringers.

9. Account Management and Subscription

9.1 Account Security

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

9.2 Subscription and Payment

ThriveHigh AI offers both trial and paid subscription plans (₹299/month). Payment terms, refund policies, and subscription details are subject to our separate Subscription Terms. All fees are non-refundable unless otherwise stated in writing.

9.3 Changes to Pricing

We reserve the right to modify our pricing and subscription plans at any time. We will provide reasonable notice of any price changes, and such changes will take effect at the start of your next billing cycle.

10. Study Groups

If you participate in the Study Groups feature:

You are responsible for all content you share within Study Groups
You agree not to share copyrighted materials without proper authorization
Other group members may view, copy, or use materials you share
We are not responsible for how other group members use shared content
You agree to respect the intellectual property and privacy rights of other group members

11. Third-Party Services

Our Service operates through WhatsApp, which is owned and operated by Meta Platforms, Inc. Your use of WhatsApp is subject to WhatsApp's separate Terms of Service and Privacy Policy. We are not responsible for WhatsApp's practices, and any issues related to WhatsApp's platform should be directed to Meta/WhatsApp.

We may also integrate with other third-party services or platforms. We are not responsible for the availability, content, privacy practices, or terms of use of any third-party services.

12. Termination

12.1 Termination by You

You may stop using our Service at any time. You can request account deletion by contacting us at contact@thrivehigh.ai.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms
Uploading infringing or prohibited content
Engaging in fraudulent or illegal activities
Non-payment of subscription fees
Abusive behavior toward our team or other users

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your User Content and account data, though we may retain certain information as required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination will survive, including intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Acceptable Use Policy

You agree NOT to use the Service to:

Violate any applicable laws, regulations, or third-party rights
Engage in or promote academic dishonesty, cheating, or plagiarism
Upload malicious code, viruses, or anything that could damage or interfere with the Service
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated tools (bots, scrapers, etc.) to access the Service without our permission
Reverse engineer, decompile, or attempt to extract the source code of our AI models or technology
Use the Service for any commercial purpose without our written consent
Harass, abuse, or harm other users or our team members
Impersonate another person or entity
Collect or store personal data about other users without their consent

14. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you consent to our data practices as described in our Privacy Policy, available at thrivehigh.ai/privacypolicy.html.

15. AI-Generated Content Disclaimer

ThriveHigh AI uses artificial intelligence and machine learning to generate responses, study insights, and recommendations. While we strive for accuracy, AI-generated content may contain errors, inaccuracies, or outdated information. You acknowledge and agree that:

AI-generated responses should be used as study aids, not as definitive or authoritative sources
You are responsible for verifying all information before relying on it for academic work
We are not liable for any incorrect, incomplete, or misleading AI-generated content
You will not use AI-generated content to submit as your own work or engage in academic dishonesty

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

Posting the updated Terms on our website with a new "Effective Date"
Sending a notification via WhatsApp or email
Displaying a prominent notice within the Service

Your continued use of the Service after any changes indicates your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

17.2 Jurisdiction

You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Service shall be instituted exclusively in the courts located in Bangalore, Karnataka, India. You irrevocably submit to the jurisdiction of such courts and waive any objection to venue in such courts.

17.3 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve any dispute informally by contacting us at contact@thrivehigh.ai. We will attempt to resolve the dispute informally within 30 days.

18. Miscellaneous

18.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Service, constitute the entire agreement between you and ThriveHigh AI.

18.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.

18.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, pandemics, or failures of third-party services (including WhatsApp).

18.6 Language

These Terms may be translated into other languages for your convenience. In the event of any conflict between the English version and a translated version, the English version shall prevail.
